Information on how to enter and Prizes (defined below) forms part of these Conditions of Entry. Entry into the “Chance to Win a SMEG Stand Mixer valued at $799 RRP” Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
Promotion commences at 12:00am AEST on 30^th August 2023 and closes on 26^th September 2023 at 11.59 pm AEST (Promotion Period).
The promoter is Kimberly-Clark Australia Pty Limited (ABN 65 000 032 333), Level 4 100 Arthur St, North Sydney, NSW 2060, Australia, Tel (02) 9963 8888 (Promoter).
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
To enter the Promotion, Entrants must complete the following steps during the Promotion Period:
1. Buy any 2 Viva products, in a single transaction from a Participating IGA, Foodland or Foodworks store (Qualifying Purchase). A Participating IGA, Foodland or Foodworks store is any IGA, Foodland or Foodworks store in Australia that displays material advertising this promotion;. Entrants must retain their Qualifying Purchase receipt. In the event that a purchase receipt is not provided to them, it is the individual’s responsibility to request one.
2. After making a Qualifying Purchase and collecting their Qualifying Purchase receipt, visit www.viva-cleaning.com.au/IGA (Promotion Website) and follow the prompts on the Promotion entry page, to input the requested details and submit the fully completed entry form (Entry).
3. Multiple Entries permitted, subject to the following: (a) only one Entry permitted per Qualifying Purchase; (b) a maximum of one Entry per person per day; and (c) each Entry must be submitted separately and in accordance with these Terms and Conditions.
4. Each entrant may win up to one Prize (see clause 16 below) (Excluding SA).
Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
Incomplete or indecipherable Entries (including purchase receipts that in the opinion of the Promoter are not legible or valid) will be deemed invalid.
The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
There will be a random electronic draw conducted at 3pm on Friday, 29^th September 2023. All Draws will be conducted at Level 2, 11 York Street, Sydney NSW 2000. The first 100 valid entries drawn randomly will win a Prize.
The Promoter may draw additional reserve Entries in a draw and record them in order, in case a winning Entry/entrant is deemed invalid or a Prize is unclaimed (Reserve Entrants).
Winners will be notified by email or phone within two business days of the relevant draw and the name of all winners will be published on www.viva-cleaning.com.au/promotions on Wednesday 4th October 2023.
If any dispute arises between an entrant and the Promoter concerning the conduct of this competition or claiming a Prize, the Promoter will take reasonable steps to consider the entrant’s position, and to respond within a reasonable time.The Promoter’s decision is final and no correspondence will be entered into.
The first valid 30 Entries drawn will win SMEG stand mixer valued at $799 RRP.
There are a total of 30 winners. The total Prize pool value is up to $23,970(AUD).
The prize may vary to the image shown on instore display material. This includes but not limited to (Colour, size, weight and shape)
The Prizes (including any unused portion of a Prize) cannot be transferred, exchanged, replaced or redeemed for cash. The Prizes must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute a Prize (or a part of a Prize) with a prize or prizes of equal or greater value (including where a Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a Prize (or an element of a Prize, including by specifying their preferred size and range of nappy / nappy pant) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
If a Prize has not been accepted or claimed by 2pm (AEST) on 1^st November 2023 or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by 2pm (AEST) on 1^st November 2023, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out a draw for any unclaimed prizes on 3^rd November 2023 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two business days of the draw and have their name published on www.viva-cleaning.com.au/promotions on 10th November 2023.
The Promoter and its associated agencies or companies accept no responsibility for any lost or misdirected Entries.
Any cost associated with accessing the Promotion Website is the entrant’s responsibility and is dependent on the Internet service provider used.
Any Entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be void.
If for any reason this Promotion is interfered with in any way or is not capable of running as planned due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to: (a) modify suspend, terminate or cancel the Promotion as appropriate, subject to approval of the gaming authorities in each State and Territory where relevant; (b) disqualify any entrant.
The Promoter has no control over Internet or mobile telephone communications, network lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.
Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Entry is conditional on providing this PI. Competition Terms and Conditions

The VIVA House of Spills Challenge is a nationwide competition to find Australia’s ‘fastest’ cleaner. (the Competition)

Entry into the Competition is deemed to be an acceptance of the below Terms and Conditions. Capitalised terms have the meaning given in these Terms and Conditions

Competition Details

Promoter

Relevant Dates

The following dates are relevant to the Competition, and will be referred to in these Terms and Conditions according to the defined terms given below:

Competition Period	The competition commences at the Competition Start Date and closes at the Competition End Date.
Challenge Date	A day in or around the week commencing 4^th March 2024 (inclusive), the exact date to be confirmed by the Promoter by no later than 7 February 2024, and subject to change as notified by the Promoter.

Eligible Entrants

Entry is open to residents of Australia, aged 18 years and over.
Employees (and their immediate families) of the Promoter, its related entities and any agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entrants must be available and willing to travel to Sydney, New South Wales to participate in the VIVA House of Spills Challenge on the Challenge Date.

How to Enter

To enter, entrants must, during the Competition Period:
1. submit a photo of their best cleaning attire and a cleaning action shot;
2. describe in two hundred (200) words or less why they have the skills and/or knowledge to be crowned Australia’s fastest cleaner;
3. provide their name, age, residential address, email and telephone number; and
4. visit the competition entry page at: https://www.viva-cleaning.com.au/houseofspills and submit their entry as instructed.

Limits on Entry

Multiple entries not permitted. One Entry per person only.

Game of Skill

The Competition is a game of skill, chance plays no part in determining the Finalists or Winner.

Finalists

Following the Competition End Date, the Promoter will review each Entry and select six (6) finalists (Finalists).
Selection of the Finalists will be based on the relevance and creativity of each Entry and will take place on Tuesday 6 February 2024 at the offices of: We are Different PR, Level 4, 130 - 144 Cleveland Street, Chippendale, NSW 2008.
The Finalists will be selected to participate in the VIVA House of Spills Challenge (Challenge) and will receive the following from the Promoter (Finalist Prize), subject to these Terms and Conditions:
1. if living outside of New South Wales, a return domestic economy class flight to Sydney (for one person);
2. if living within New South Wales, transport to and from Sydney (for one person);
3. a one-night stay in a single room (for one person) at a four-star hotel in Sydney (including for NSW based Finalists);
4. a voucher for transport, food and beverages up to the value of AUD$500.
The total value of the Finalist Prize is approximately [AUD $5,000]
Travel and accommodation is subject to availability and chosen by the Promoter.
Unless expressly stated otherwise, travel and accommodation does not include: any other travel or accommodation not expressly stated in these terms and conditions; additional persons; any overnight accommodation while travelling to the departure airport (if applicable); meals, ground transportation and incidentals; any incidental accommodation charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); any insurance (such as travel or health cover) however the Promoter may, on request, require a Finalist to take out travel insurance (at their expense) for the relevant period; or any other ancillary costs which may be incurred by a Finalist.
Once confirmed in writing, travel and accommodation dates, bookings and names may not be changed, except in the sole discretion of the Promoter and (if so) at the expense of the Finalist.

Participation in the Challenge

All Finalists selected to participate in the Challenge will be required, as a condition of participation, to:
1. Execute a separate agreement with the Promoter (Talent Agreement) which will provide, amongst other terms, that in consideration of the Finalist Prize and the opportunity to participate in the Challenge, each Finalist: 1) consents to the photography and filming of the Finalist’s participation in the Challenge; 2) agrees that the Promoter will own all rights in images, recordings, submissions and contributions made by the Finalist relating to, or arising from, Entry in the Competition and participation in the Challenge; and 3) agrees to carry out the VIVA Ambassador Responsibilities if selected as the winner of the Challenge (see clause 14 below).
2. Execute all waivers, consents and release agreements required by the Promoter.
3. Be available to travel to Sydney, New South Wales, to participate in the Challenge, in person, on the Challenge Date, the exact location of which will be confirmed by the Promoter prior to the Challenge Date.
4. If selected as winner of the Competition, be available to the Promoter and remain in Sydney for an additional day and overnight stay immediately following the Challenge Date in order to carry out the VIVA Ambassador Responsibilities (the costs of which will be borne by the Promoter on the same terms outlined in these Terms and Conditions).
5. Be in possession of all necessary/required documentation and travel documents to allow travel to Sydney - all travel documentation is the sole responsibility of the Finalists;
6. Hold a valid credit card and present it on check in at the accommodation establishment, to cover any incidental hotel charges.
7. Comply with all health, safety and travel rules, passport, visa and any other rules, guidance, protocols, policies and procedures for entry into New South Wales from interstate.
8. Comply with any terms and conditions that may be imposed by any third party that may be involved in providing goods and services to a Finalist (including, but not limited to, third party airline services, accommodation and transport providers).

Finalist Notification

The Promoter will notify the selected Finalists via email and/or phone call by Wednesday 7 February 2024. To accept, a Finalist must, within seven (7) days following notification:
1. confirm their availability to participate in the Challenge on the Challenge Date;
2. provide the Promoter with sufficient information to arrange travel and accommodation; and
3. execute and return to the Promoter the Talent Agreement and any other waivers, consents and release agreements required by the Promoter.
If, in the sole opinion of the Promoter, a Finalist is unavailable, unwilling and/or does not accept the Finalist selection in accordance with this clause 9, then that Finalist entry will be deemed invalid and the Finalist selection forfeited, and the Promoter may, in its sole discretion, opt to select a replacement finalist in accordance with clause 15.

VIVA House of Spills Challenge

The Challenge will:
1. take place in Sydney, New South Wales over one full day on the Challenge Date;
2. involve a series of timed cleaning challenges;
3. be a recorded in-person event; and
4. be hosted by a celebrity ambassador and crew of cleaning judges selected by the Promoter.

Winner

One (1) winner will be selected from the Challenge based on whichever Finalist is judged to be the fastest cleaner overall to complete the cleaning challenges set by the cleaning judges (Winner).

Winner’s Prize

The Winner will:
1. receive a cash prize in the amount of AUD $5,000 (Cash Prize), which will be provided to the Winner in the form of a pre-paid Visa or Mastercard gift card;
2. be crowned ‘Australia’s Fastest Cleaner’ by the Promoter; and
3. be engaged as VIVA Ambassador by the Promoter for a period of twelve (12) months during which time the Winner will carry out the VIVA Ambassador Responsibilities (see clause 14 below).

(Winner’s Prize)

The total value of the Winner’s Prize is approximately AUD$5,000.

Prize value

All amounts and (where applicable) prize values are correct as at the date of these Terms and Conditions and are in Australian Dollars, but to the extent permitted by law, no responsibility is accepted by the Promoter for any variation in amounts/value after the date of these Terms and Conditions.

VIVA Ambassador Responsibiliti es

The Winner, as the VIVA Ambassador, will be required to carry out the VIVA Ambassador Responsibilities, which will be detailed in the Talent Agreement, and will include the following:
1. Participating in media opportunities, including TV appearances, interviews and photo opportunities before and/or after the Challenge Date (approximately 5 hours);
2. appearing in VIVA House of Spills campaign content (to be used across social, digital and PR channels);
3. refraining from promoting, endorsing or acting as a spokesperson for any brands or products which compete with the VIVA brand in Australia and New Zealand for a period of 12 months from the date of the Talent Agreement; and
4. not engaging in any conduct (including making of verbal or written statements) which is unlawful or likely to bring the Promoter or the VIVA brand into disrepute.
All media opportunities (TV appearances, interviews and photo opportunities as referred to above) will be conducted during the week of the Challenge. Filming will be conducted on the Challenge Date as well as the day after the Challenge Date.

Replacement Finalist

If, in the sole opinion of the Promoter, a Finalist is unavailable, unwilling, and/or does not accept the Finalist selection in accordance with these terms and conditions (see Finalist Notification) by Tuesday 13 February 2024 then that Finalist entry will be deemed invalid and the Finalist selection forfeited, and the Promoter may, in its sole discretion, opt to select a replacement finalist.
The Promoter will notify any replacement finalist selected via email and phone by 14 February 2024.
To accept the selection of replacement finalist, the replacement finalist must, within a reasonable timeframe requested by the Promoter having regard to the Challenge Date and time involved in arranging travel and accommodation: execute and return the Talent Agreement and any other waivers, consents and release agreements required by the Promoter; confirm their availability to participate in the Challenge on the Challenge Date and provide the Promoter with sufficient information to arrange travel and accommodation.
The Promoter may, in its sole discretion, choose not to select a replacement finalist.

Other Key Terms

Subject to any separate agreement entered in to with the Promoter, by submitting an Entry, each entrant consents to the Promoter using their name, image, voice, likeness and Entry for an unlimited period of time without remuneration and grants the Promoter and its affiliates, agents and representatives an non-exclusive, royalty-free, perpetual, irrevocable, transferable, worldwide licence to use, edit, reproduce and exploit their Entry by all means whatsoever (including, without limitation, in print and electronic format) for the purpose of promoting this Competition, the Challenge (including any outcome) and the VIVA brand.
By submitting an Entry, each entrant waives any right to inspect or approve any use, edit or reproduction by or on behalf of the Promoter of all or any part of the entrant's Entry and consents to any act or omission that would otherwise infringe an entrant’s “moral rights” (as set out in Part IX of the Copyright Act 1968 (Cth)) in the Entry.
By submitting an Entry, the entrant declares that the Entry is their own original work and not copied in whole or in part from any other person, all persons featured in an Entry have provided their consent to do so in accordance with these Terms and Conditions, does not infringe the intellectual property rights of any third party and is accurate and in no way misleading.
Even if selected as a Finalist or Winner, appearance on any recording or other media which promotes the Challenge is not guaranteed. The Promoter has the right to stand down any Finalist or Winner in its sole discretion.
The Promoter reserves the right at any time and in its sole discretion to disqualify an entrant, Finalist or the Winner from the Competition or Challenge should it deem any such person unsuitable to participate in the Competition or Challenge and/or, if in the Promoter’s opinion, an entrant, Finalist or Winner supplies untruthful, inaccurate or misleading personal details or other information, or otherwise breaches the rules of the Challenge (as notified to each Finalist on the Challenge Date) and/or breaches these Terms and Conditions.
Unless expressly stated otherwise, all ancillary costs including but not limited to insurance, taxes (including GST), meals, drinks, transport, transfers, spending money, fuel, oil and services costs, safety gear to comply with state and territory regulations, in-room charges and any and all other expenses incurred as a consequence of being selected as a Finalist and/or receiving the Winner’s Prize are the sole responsibility of the Finalists and Winner, as the case may be.
Prizes are not transferable and are not redeemable for cash. In particular, travel, accommodation, vouchers and prizes may not, without the prior consent of the Promoter and any applicable third party supplier of the prize (Supplier), be changed, resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If any travel, accommodation, vouchers or prizes are sold or used in breach of this condition, the Promoter or the Supplier may, at their absolute discretion, withdraw travel, accommodation, vouchers or prize(s). Where this occurs (withdrawal in accordance with this clause), no refund, substitute or compensation will be offered and if the prize is a ticket, the winner and any person has purchased or otherwise bears that ticket will be refused entry.
If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various authorities (if applicable).
If an entrant’s contact details change at any time between the date which they enter the Competition and the Challenge Date, that entrant must notify the Promoter of their correct contact details immediately. It is the responsibility of each entrant to ensure that their telephone number, residential address and email address is up to date.
The Finalists should refer to any vouchers (if applicable) or travel documents for terms and conditions of use and expiry, if relevant. Travel, accommodation and vouchers are subject to such other terms and conditions as may be imposed by those involved in providing other goods or services (“Third Party Terms”).
Finalists are responsible for compliance with any health, passport, and other requirements for entry into Sydney, New South Wales, Australia (if applicable) (“Entry Requirements”). Finalists are responsible for making themselves familiar with, and following, the Australian Government’s travel advisory advice.
The Promoter reserves the right to request verification of age, identity, residential address of entrants, Finalists and the Winner and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, is in breach of these conditions, provides entries that are offensive or otherwise inappropriate in the sole opinion of the Promoter, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this Competition, the Challenge, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
The entrants, Finalists and Winner participate in this Competition and any travel or other activities contemplated by it at their own risk, and agree that the Promoter shall not be liable for any loss, damage or injury suffered or sustained as a result of accepting and/or using the Finalist Prize or the Winner’s Prize, except for any liability which cannot be excluded by law. The Promoter strongly encourages and may require evidence that Finalists have procured adequate travel insurance coverage for the period of any travel contemplated by the Competition, at their own expense.
In addition to the above and generally, the Promoter and its associated agencies and prize fulfilment partners are not responsible for and are released from any personal injury that may be caused to any of the entrants, Finalists or the Winner during participation in this Competition and the Challenge, and for any personal property that may be lost or damaged during participation. The Promoter assumes no liability for (and will provide no compensation to) an entrant, Finalist or Winner and/or any travel companion (if applicable) who, as a result of any failure to comply with any Third Party Terms or Entry Requirements: (a) is unable to participate in the Competition (or any part of it, including in circumstances where a Finalist forfeits or misses a flight); (b) is refused entry to a hotel, flight or other transportation vehicle; or (c) suffers any other loss, injury, or damage.
Any goods and/or services (including prizes) supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any Finalist or Winner as a result of the conduct of any third party supplier or otherwise as a result of a Finalist or Winner accepting and/or using goods/services and/or a prize (even if caused by negligence), except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
If in the conduct of this Competition, the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 (Cth) or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.

Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

Incomplete or indecipherable Entries (including purchase receipts that in the opinion of the Promoter are not legible or valid) will be deemed invalid.

The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion.

Prizes will be awarded to the person named in the Entry form. Any claim that is made on behalf of a person named in the Entry form, or any claim made by a third party, will be invalid. If there is a dispute as to the identity of the person named in the Entry form, the Promoter reserves the right, in its sole discretion, to determine the identity of that person.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Prize

There will be a random electronic draw performed in the presence of an independent scrutineer at 3pm on 31.01.25. All draws will be conducted at Level 2, 11 York Street, Sydney NSW 2000.

The first 4 valid Entries drawn randomly will win $5,000 each, which will be rewarded in the form of a VISA gift card ( Prize ).

As at the date of these Terms and Conditions, the Prize amount of $5,000 equals the average cost of domestic cleaning services over a 12 month period, based on the average cost of a fortnightly standard clean of a 3 bedroom single storey home.

The total Prize pool value is $20,000 (AUD).

The Promoter may draw additional reserve Entries in a draw and record them in order, in case a winning Entry/entrant is deemed invalid or a Prize is unclaimed (Reserve Entrants).

Winners will be notified by email within five business days of the relevant draw and the last name, initial of the first name and postcode of all winners will be published on viva-cleaning.com.au/bigw on the 07.02.25

If any dispute arises between an entrant and the Promoter concerning the conduct of this competition or claiming a Prize, the Promoter will take reasonable steps to consider the entrant’s position, and to respond within a reasonable time. The Promoter’s decision is final, and no correspondence will be entered into.

The Prize (including any unused portion of a Prize) cannot be transferred, exchanged, replaced, or redeemed for cash. The Prize must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute a Prize (or a part of a Prize) with a prize or prizes of equal or greater value (including where a Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.

Subject to clause 25 these Terms and Conditions, if for any reason a Prize is unclaimed by the time stipulated by the Promoter or a winning Entry is deemed invalid or void, then the Prize (or that element of the Prize) will be forfeited.

If a Prize has not been accepted or claimed by 2pm (AEDT) on the 30.04.25 or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by 2pm (AEDT) on the 30.04.25, the relevant Entry/ies will be discarded and the Promoter may carry out a draw for any unclaimed prizes on the 01.05.25 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two business days of the draw and have their last name, initial of the first name and postcode published on www.viva-cleaning.com.au/bigw on the 09.05.25..

The Promoter and its associated agencies or companies accept no responsibility for any lost or misdirected Entries.

Any cost associated with accessing the Promotion Website is the entrant’s responsibility and is dependent on the Internet service provider used.

Any Entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be void.

If for any reason this Promotion is interfered with in any way or is not capable of running as planned due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to: (a) modify suspend, terminate or cancel the Promotion as appropriate, subject to approval of the gaming authorities in each State and Territory where relevant; (b) disqualify any entrant.

The Promoter has no control over Internet or mobile telephone communications, network lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for any reason.

Nothing in these Terms and Conditions excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees under any applicable law including Competition and Consumer Act 2010 (Cth) as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

Except for any liability that cannot by law be excluded including the Non-Excludable Guaratees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) this Promotion; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, unauthorised access or third party interference; (d) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in Prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) taking and/or use of a Prize.

Any Prize, goods and/or services supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any Winner as a result of the conduct of any third party supplier or otherwise as a result of a Winner accepting and/or using goods/services and/or a Prize (even if caused by negligence), except for any liability which cannot be excluded by law.

The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.kimberly-clark.com/en-au/privacy. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).

All amounts and (where applicable) prize values are correct as at the date of these Terms and Conditions and are in Australian Dollars, but to the extent permitted by law, no responsibility is accepted by the Promoter for any variation in amounts/value after the date of these Terms and Conditions.
